Emmanuel Udende of the All Progressives Congress (APC) was declared the victor of the Benue North East Senatorial seat by the Abuja Division of the Court of Appeal on Wednesday.
The Benue State National Assembly Election Petition Tribunal, presided over by Justice Ori Zik-Ikeoha, had previously ruled in favor of Senator Gabriel Suswam.
However, Emmanuel Udende and his APC party filed an appeal against the ruling. The appellants asked the court to overturn the decision of the Benue State National Assembly Election Petition Tribunal, which recognized Suswam of the Peoples Democratic Party, PDP, as the legitimate winner of the Benue North East Senatorial seat.
On Wednesday, the Appeal Court upheld the appeal and overturned the lower court’s verdict.
and confirmed Emmanuel Udende, who had previously been pronounced the winner of the Benue North East senatorial seat by the Independent National Electoral Commission (INEC).
The appellate court’s three-judge bench ruled that the lower court erred in proclaiming Susam the election winner.
The Appeal Court ruled that the tribunal’s re-calculation of the votes was incorrect, and it called into question the mechanism employed in deducting votes from the APC’s votes.
